Please read these Terms of Service carefully before using the services of Global Equity Solutions ("Company," "we," "our," "us"). All engagements operate strictly on transparent, formal written agreements.

Global Equity Solutions operates with complete legal transparency. All services are governed exclusively by a mutually agreed, legally executed Client Agreement & Power of Attorney before work begins:
- Statutory / Government Expenses: Stamp duty, Legal Heir Certificate, Succession Certificate, and official Civil Court fees are paid directly by the client as applicable to their specific jurisdiction.
- Professional Success Fee: Our professional advisory fee is strictly based on the defined Scope of Work and a pre-decided percentage (%) of the prevailing market rate on the exact date of transfer and credit of shares in your Demat account.
- Binding Formal Agreement: Everything will be 100% transparent and executed strictly on the basis of our signed Agreement — with zero hidden charges or unexpected retainers.
1. Acceptance of Terms
By accessing our website (https://globalequitysolutions.in), submitting an online case intake, or executing a formal Client Agreement, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please refrain from using our advisory services.
2. Description & Scope of Services
Global Equity Solutions provides legal and corporate advisory services across:
- IEPF Claims Recovery: Investigating, drafting, and filing Form IEPF-5 with the Ministry of Corporate Affairs for recovery of unclaimed shares and accumulated dividends.
- Physical Share Dematerialization: Resolving SEBI Form ISR compliances, signature mismatches, address updates, and converting physical scrips into Demat.
- Succession & Estate Transmission: Facilitating transmission upon the death of the original shareholder, obtaining Succession Certificates, Probates, or Letters of Administration from competent civil courts.
- Issue of Duplicate Share Certificates: Reclaiming lost, stolen, torn, dismantled, or mutilated physical share certificates under SEBI Form ISR-4 guidelines.
- Cross-Border NRI Asset Recovery: Tailored remote power-of-attorney drafting, consular attestation/apostille guidance, and direct NRO Demat credit for global Indian families.
3. Transparent Fee Structure & Client Agreement
Our financial arrangement is built on utmost clarity and fair contractual ethics:
- Mutually Agreed Formal Contract: All advisory engagements are governed by a written, signed Client Agreement executed prior to initiating representation.
- Performance-Based Percentage (%): Our professional fee is calculated on the defined Scope of Work and a mutually agreed fixed percentage (%) of the total market value of the shares, evaluated at the prevailing market rate on the date of successful transfer and credit into your Demat account.
- Zero Advance Retainer: We do not charge arbitrary upfront retainers for initial case evaluation and verification.
- Government & Statutory Charges: Stamp duty, Legal Heir Certificate, Succession Certificate, court stamp fees, gazette notifications, or statutory government filing levies are payable by the client as applicable based on territorial court jurisdictions.
- Invoicing & Settlement: Professional fee invoices are raised only upon successful credit of the recovered shares or funds, payable within the stipulated period defined in the Client Agreement.
4. Client Responsibilities & Due Diligence
To ensure smooth and timely execution of claims, the client agrees to:
- Furnish authentic, valid, and un-tampered identity, KYC, bank proofs, and shareholding records.
- Execute required affidavits, indemnities, powers of attorney, and authorization letters promptly.
- Bear statutory out-of-pocket court fees, stamp duties, and succession certificate application costs in their respective civil court jurisdiction.
- Maintain strict confidentiality regarding the terms, fee structure, and correspondence of the signed Client Agreement.
- Refrain from engaging multiple concurrent recovery agents for the same folio or IEPF claim during the term of our active agreement.
5. Disclaimer of Timelines & Judicial Outcomes
While Global Equity Solutions applies diligent securities law expertise, the final timelines and approval cycles are governed by statutory regulatory bodies (MCA, IEPF Authority, RTAs, Listed Corporate Secretarial Desks) and Civil Court dockets. Consequently:
- We do not guarantee static timeline deadlines, as verification speed is subject to government and judicial authority schedules.
- The absolute terminal value of recovered equity portfolios fluctuates based on prevailing stock market prices on the date of transfer.
6. Confidentiality & Data Security
All client documents, folios, genealogical records, and financial statements are safeguarded under strict institutional data protection protocols and the Digital Personal Data Protection (DPDP) Act, 2023. No client information is shared with unauthorized third parties.
7. Regulatory & Non-Affiliation Disclaimer
Global Equity Solutions is an independent private corporate and legal consultancy practice. We are NOT a government department and are not directly affiliated with the IEPF Authority, Ministry of Corporate Affairs, or SEBI. Investors retain the statutory right to file Form IEPF-5 independently on the MCA portal at no cost.
8. Governing Law & Jurisdiction
These Terms of Service and all executed Client Agreements shall be governed by and construed in accordance with the substantive laws of India. Any legal dispute or claim arising out of or related to our services shall be subject to the exclusive jurisdiction of the competent civil courts at Gurugram, Haryana.
