High-value and non-resident claims
The sectors along Golf Course Road hold a concentration of senior executives, founders and families who have spent part of their working lives outside India. Two patterns follow. Inherited portfolios here often exceed SEBI’s ₹10 lakh per company threshold, which moves a family from a simple indemnity bond to a will, legal heir certificate or succession certificate.
And claimants are frequently non-resident. An affidavit signed in Dubai or Singapore is not usable in India until it is notarised and then apostilled or attested at an Indian mission — the UAE is not a party to the Apostille Convention, so documents signed there need consular attestation rather than an apostille.
What the paperwork looks like at this end of the market
Value is what decides the route, company by company rather than across the whole estate. Above the thresholds, registrars want a will with an indemnity bond, a legal heirship certificate with an indemnity bond, or a succession certificate, in every case alongside an affidavit-cum-NOC from the other heirs.
In Haryana the legal heir certificate comes from the Tehsildar, applied for through the Antyodaya Saral portal or at a Tehsil, SDM or e-Disha centre, with a Patwari verifying the family details.
- A per-company valuation before choosing a route — the ₹10 lakh limit applies per company, not per estate
- Affidavit-cum-NOC from every other legal heir, notarised, and apostilled or consular-attested if signed abroad
- For NRIs: a demat account, usually linked to an NRO account, opened before the claim is filed
- PAN and passport or OCI card for non-resident claimants

Questions from Golf Course Road
I live abroad and the shares are in Gurugram. Do I need to fly in?
Usually not. Documents are signed and notarised where you live, then apostilled or attested at an Indian mission, and the shares are credited to your Indian demat account.
Does an apostille work for documents signed in Dubai?
No. The UAE is not a party to the Hague Apostille Convention, so documents signed there are authenticated through attestation ending at the Indian embassy or consulate. Countries such as the UK, US, Canada, Singapore and Saudi Arabia do use apostilles.
Our family holding is worth well over ₹10 lakh. What changes?
SEBI’s simplified route no longer applies to that company’s shares. You will need a will, a legal heirship certificate or a succession certificate, along with the other heirs’ affidavit-cum-NOC. Probate is not compulsory.
Can sale proceeds be sent abroad?
NRIs can generally remit up to USD 1 million per financial year from NRO balances, including proceeds of inherited assets, with Form 15CA and a chartered accountant’s certificate in Form 15CB. Your bank will confirm what it needs.
Do you charge by the hour?
No. There is no advance professional fee and the assessment is free; we charge an agreed percentage of the value once the shares are credited. Court fees, stamp duty and attestation costs are paid by you at actuals.
